区域自然保护地役权制度改革的探索——以江山雪岭社会公益型自然保护项目为例

Exploration of Easement System in Jiangshan Xueling Nature Area

  • 摘要: 2021 年1 月，江山雪岭社会公益型自然保护地正式登记成立，总面积为4 259 hm2，其中林地面积为4 225 hm2，耕地面积为34 hm2。以江山市廿八都镇人民政府为地役权人，与第三方公益组织深圳市桃花源生态保护基 金会签订合同，将此前已与1 210 户农户达成协议的4 225 hm2 集体林地交予基金会管理。结果表明，该基金会在 科学管理、降低管护成本、强化农户合作以及提升保护效力等方面具有优势，该尝试通过物权制度的使用和社会 公益组织的参与，有效降低了行政、财政和宣教成本，提高了保护效能。这为我国地方级自然保护地实施“公益 治理”模式提供了新的可能，也为我国自然保护地役权制度的探索提供了新的案例。

     

    Abstract: In January 2021, a public welfare organization, Jiangshan Xueling Nature Center, Zhejiang province, was registered and established, with total area of 4 259 ha, among them, collective forest of 4 225 ha, farmland of 34 ha. The People’s Government of Nianbudu Town signed contract with the third public organization, Shenzhen Taohuayuan Ecological Conservation Foundation to manage 4 225 ha collective forest (after agreement of village committee with 1 200 households). The result demonstrated that the management of the Foundation had advantages of professional administration, reducing financial cost, better cooperation with farmers and increasing conservation effect.
